A Child Gaining Possession of a Firearm (Art. 13/A)

Article 13/A was added to this Law as a result of recent incidents.

“Article 13/A- (Added: 8/8/2026-7593/1 Art.) A person who, by keeping a firearm in breach of the duty of care and diligence, causes a child to gain possession of it shall be punished with imprisonment from one to three years, unless the act constitutes another offence requiring a heavier penalty.”

Law No. 6136, Art. 13/A

Looking at the provision, it expressly refers to firearms. In other words, this article of the Law does not treat knives contrary to this Law as instruments of the offence.

Secondly, it would not be wrong to say that the Law provides for a subjective duty of care and diligence, since it is clear that the manner and extent of the care and diligence required will be assessed according to the particular circumstances of each case.

Thirdly, the situation which this provision of the Law is designed to address, namely a child gaining possession of a firearm, must actually occur. For the purposes of criminal law, a child is defined as a person aged 0 to 18.

Example

To give an example, where a 17-year-old child takes a firearm, whether or not it is licensed for carrying, from an unlocked chest at home and has it in his or her possession, the person responsible for keeping the firearm secure will have committed this offence and will face imprisonment from 1 to 3 years.

  • Subject of the offence: Firearms only; knives are not treated as instruments of the offence in this article.
  • Care and diligence: Assessed according to the particular circumstances of each case.
  • Result: A child must gain possession of the firearm.

Weapons Whose Unlicensed Possession Is an Offence

Under Law No. 6136 and Article 2 of the Regulation on Firearms, Knives and Other Instruments, the weapons whose possession, carrying or purchase without a licence is an offence are as follows:

  • Firearm: refers to weapons capable of firing bullets or specially shaped and constituted materials known as shot over long distances by means of propellant gas or an explosive and propelling force of that kind.
  • Pistol: refers to firearms manufactured for a barrel of a certain calibre, not being fully automatic, with a barrel length not exceeding 30 centimetres excluding the chamber and an overall length not exceeding 50 centimetres, capable of firing balls, bullets, shot or rockets, gas or other objects by means of smoke or smokeless powder or an explosive and propelling force of that kind.
  • Fully automatic weapon: rifled firearms capable of continuous fire while the trigger is held down.
  • Rifled hunting rifle: refers to rifled firearms with a barrel length exceeding 30 centimetres excluding the chamber, having long range and penetrating power, a fixed stock, no fully or semi-automatic firing capability, and used exclusively for hunting or shooting sports. Rifled hunting rifles are subject to licensing under paragraph 4 of Article 4 of Law No. 6136.

We have discussed matters that may arise in criminal proceedings, such as the summary proceedings procedure, deferral of the announcement of the verdict and limitation periods in criminal law , in separate articles.
