In public procurement, most rights are lost not because there was no unlawfulness, but because it was not raised in time. The periods prescribed for complaints and appeals on complaint are short and preclusive; an application made to the wrong authority or a day late will be rejected without the merits being considered.

UTU Hukuk & Danışmanlık provides legal support to tenderers and contracting authorities in proceedings under Laws nos. 4734 and 4735, from objections to tender documents and qualification assessments to abnormally low tender explanations and disputes arising during performance of the contract.

The work is not limited to drafting the application. Because an error in a document made while preparing the tender file usually cannot be remedied afterwards, reviewing the documents before submitting the tender is the most effective stage.

Authorities

Which authorities hear Public Procurement Law cases?

Depending on their nature, Public Procurement Law cases are handled before Contracting Authority, Public Procurement Authority, Administrative Court, Regional Administrative Court, Council of State and Commercial Court of First Instance. The authority before which the matter is heard determines the applicable procedure and time limits from the outset. An application to the wrong authority usually results in lost time.

Process

How do we work?

Every file goes through the same four steps. A stage that is rushed increases the cost of the one that follows.

01

Preliminary meeting

We listen to the subject of the file, its stage and the time limits. A conflict-of-interest check is carried out. The meeting is held by appointment and on a confidential basis.

02

Document review

Existing documents, service dates and the case file, if any, are examined. We establish which time limits are running and which rights can still be exercised.

03

Roadmap

Options are set out in writing together with their likely outcomes and costs. The engagement and the fee are agreed in a written contract before work begins.

04

Execution and reporting

Information is provided at every stage as the matter proceeds. Hearings, service and time limits are notified in advance; no surprises are left.

Q & A

Public Procurement Law — frequently asked questions

As a rule, a complaint must first be made to the contracting authority, and an appeal on complaint made to the Public Procurement Authority after service of the authority's decision or expiry of the period for reply. The periods are short and preclusive; the matter should therefore be assessed as soon as the decision is served.

As a rule, no. Appeals on complaint made directly are rejected on procedural grounds. The exceptions are construed narrowly; the appropriate route must be determined for each file.

No contract may be signed once an appeal on complaint has been lodged. This does not, however, mean that the tender is automatically cancelled; the outcome depends on the Board's decision.

The explanation rests on documenting the cost components on which the tender is based. A mere statement is not sufficient; price quotations, cost determination records and similar documents must be submitted in the form required by the legislation.

The period is set by law according to the nature of the conduct. If the decision is considered unlawful, administrative proceedings may be brought for its annulment; a request for a stay of execution is assessed separately.

Let us assess your file together.

At the preliminary meeting we discuss the stage of the file, the time limits running and the available options. Meetings are by appointment and confidentiality is essential.
