The support of a criminal defence lawyer in Ankara is often needed long before proceedings are brought in cases falling within the jurisdiction of the assize court, such as intentional killing, robbery, qualified fraud and organised crime offences. In criminal proceedings, the outcome is often determined by the first twenty-four hours: how the statement was given, which evidence entered the file and when, and which objection was made in time can have consequences that are difficult to remedy at later stages.

UTU Hukuk & Danışmanlık conducts defence at the police and prosecution stage, detention reviews, assize court trials, and appeal and cassation proceedings in investigations and prosecutions conducted primarily at the Ankara Courthouse and the Ankara West Courthouse. Statements, pre-trial detention and judicial control decisions at the investigation stage and the defence at the prosecution stage affect one another; for this reason, the file is structured as a whole from the outset.

Certain rules also differ in assize court cases: Article 110/A of the Code of Criminal Procedure provides for a longer maximum period of judicial control in matters falling within the jurisdiction of the assize court; claims for compensation arising from unlawful or unjustified protective measures are also, as a rule, decided by the assize court of the place where the injured party resides.

Scope

What does a serious crimes lawyer handle?

UTU Hukuk provides litigation and advisory services in Ankara in serious criminal cases on the following matters: Defence at the investigation stage, Detention and judicial control, Assize court proceedings, Deferral of the announcement of the verdict, Acting for complainants and intervening parties, Appeal and cassation and Compensation for protective measures. An assize court case consists of interconnected stages from the investigation through to legal remedies. The headings below arise within the same file or in connection with it.

01

Defence at the investigation stage

Attendance at statements before the police and the public prosecutor, submission of requests for the collection of evidence, and objections to arrest and custody measures.

02

Detention and judicial control

Objections against pre-trial detention and judicial control decisions of the criminal judgeship of peace, requests for release, and the modification or lifting of judicial control obligations.

03

Assize court proceedings

Defence at the prosecution stage in cases falling within the jurisdiction of the assize court, such as intentional killing, robbery, qualified fraud and organised crime offences.

04

Deferral of the announcement of the verdict

Assessment of the conditions for HAGB in cases where a conviction is reached: imprisonment of two years or less or a judicial fine, the defendant’s consent, no previous conviction for an intentional offence, and the remedying of the damage.

05

Acting for complainants and intervening parties

Preparation of the complaint on behalf of the injured party, intervention in the proceedings, and protection of compensation rights alongside the criminal file.

06

Appeal and cassation

Review of the reasoned judgment at the Regional Court of Appeal and Court of Cassation stages, and systematic presentation of the grounds of unlawfulness within the two-week time limits for legal remedies.

07

Compensation for protective measures

Claims for compensation under Article 141 et seq. of the Code of Criminal Procedure in cases such as unlawful arrest and detention, disproportionate searches or seizure without the conditions being met.

Authorities

Which authorities hear serious criminal cases?

At the investigation stage, the Chief Public Prosecutor’s Office and the criminal judgeship of peace are involved; at the prosecution stage, the assize court; and at the legal remedies stage, the Regional Court of Appeal and the Court of Cassation. Objections against decisions of the criminal judgeship of peace concerning pre-trial detention and judicial control are examined by the judge of the criminal court of first instance within the same judicial district.

Process

An assize court case step by step

Every assize court case goes through the same four steps. Rushing one stage increases the cost of the next.

01

Preliminary meeting

We listen to whether the file is at the investigation or prosecution stage, whether there is any police custody or pre-trial detention, and which time limits are running. A conflict of interest check is carried out. Meetings are held by appointment and on a confidential basis.

02

Document review

Statement records, the indictment if any, pre-trial detention and judicial control decisions, and expert reports are reviewed. Even where a restriction order has been issued on the file, the arrested person’s or defence counsel’s access to the statement record and expert reports is not affected by that restriction.

03

Roadmap

The defence plan is prepared together with objections and requests for release, evidentiary requests and, where applicable, the requests of the intervening party. The power of attorney and fees are set out in a written agreement before work begins.

04

Execution and reporting

You are kept informed at every stage while the proceedings are conducted. Hearings, service of documents and time limits are notified in advance; after the decision, the two-week time limits for appeal and cassation appeal are monitored in the same way.

Q & A

Criminal defence lawyer in Ankara — frequently asked questions

Intentional killing, robbery, qualified fraud and organised crime offences are among the offences falling within the jurisdiction of the assize court. Claims for compensation arising from protective measures are also, as a rule, decided by the assize court of the place where the injured party resides. It is important to identify the competent authority correctly from the outset; an application made to the wrong authority often results in time being lost.

The first step is to appoint defence counsel before any statement is taken; for this reason, the support of a criminal defence lawyer in Ankara is often needed before the file even reaches the court. Once a statement record has been signed, it is very difficult to change its content afterwards. Rights to object to the duration and conditions of police custody are also subject to limited time periods.

Objections against decisions of the criminal judgeship of peace concerning pre-trial detention and judicial control are examined by the judge of the criminal court of first instance within the same judicial district; the 2021 amendment abandoned the horizontal objection procedure and introduced a vertical objection procedure. In matters falling within the jurisdiction of the assize court, judicial control may last for a maximum of three years; where necessary, it may be extended with reasons given.

What is decisive for HAGB is that the specific sentence imposed is two years’ imprisonment or less, or a judicial fine; even if the statutory penalty for the offence is higher, the sentence may fall below this threshold, for example through a reduction for unjust provocation. The defendant’s consent, the absence of any previous conviction for an intentional offence and the remedying of the damage are also required. Under an HAGB decision, the verdict is not announced for five years; if no intentional offence is committed during this period, the case is dismissed.

For criminal court decisions (including those of criminal courts of peace, criminal courts of first instance and assize courts), the time limit for an appeal (istinaf) is two weeks from the pronouncement or service of the decision, and the time limit for a cassation appeal (temyiz) is two weeks from service. These time limits were amended to two weeks in the Code of Criminal Procedure No. 5271 by Law No. 7331.

Yes. Persons who are arrested or detained, or whose continued detention is ordered, otherwise than in accordance with the conditions laid down by law may claim compensation from the State for the pecuniary and non-pecuniary damage they have suffered. The claim must be made within three months of notification of the finality of the decision to the person concerned and, in any event, within one year of the date on which it became final; in certain cases, such as an acquittal or a decision of non-prosecution, the application is made not to the assize court but to the Compensation Commission under Law No. 6384.

Let us assess your assize court case together.

At the preliminary meeting, we discuss whether the file is at the investigation or prosecution stage, any pre-trial detention, the time limits running and the options available. Meetings are held by appointment and confidentiality is assured.
