In criminal proceedings the outcome is often determined in the first twenty-four hours. How the statement was given, when each piece of evidence entered the file and whether each objection was made in time produce consequences at later stages that are difficult to remedy. That is why the support of an Ankara criminal lawyer is needed long before the file reaches court.

UTU Hukuk & Danışmanlık handles defence at the police and prosecution stages, detention reviews, proceedings before the assize and criminal courts of first instance, and appeal and cassation processes, in investigations and prosecutions conducted principally before the Ankara Courthouse and the Ankara West Courthouse. Every file is worked to the same standard regardless of its size.

Our criminal law work spans a wide range, from economic crime to cybercrime, from negligent injury arising out of road accidents to cases in which public officials stand trial.

Scope

Which Criminal Law matters do we handle?

UTU Hukuk provides litigation and advisory services in Ankara in Criminal Law on the following matters: Defence at the investigation stage, Detention and judicial control, Assize court proceedings, Economic and cyber offences, Acting for complainants and intervening parties, Appeal and cassation and Execution of sentences. 01

Defence at the investigation stage

Attendance at statements before the police and the public prosecutor, submission of requests for the collection of evidence, and objections to arrest and custody measures.

02

Detention and judicial control

Objections to decisions of the criminal judgeship of peace, applications for release, and variation or lifting of judicial control measures.

03

Assize court proceedings

04

Economic and cyber offences

Fraud, abuse of trust, bounced cheques, forgery, unlawful access to information systems and misuse of bank cards.

05

Preparation of the complaint on behalf of the injured party, intervention in the proceedings, and protection of compensation rights alongside the criminal file.

06

Appeal and cassation

Examination of the reasoned judgment before the regional court of appeal and the Court of Cassation, and systematic presentation of the grounds of unlawfulness.

07

Authorities

Which authorities hear Criminal Law cases?

Depending on their nature, Criminal Law cases are handled before Criminal Judgeship of Peace, Criminal Court of First Instance, Assize Court, Office of the Chief Public Prosecutor, Regional Court of Appeal and Court of Cassation. The authority before which the matter is heard determines the applicable procedure and time limits from the outset. An application to the wrong authority usually results in lost time.

Process

How do we work?

Every file goes through the same four steps. A stage that is rushed increases the cost of the one that follows.

01

Preliminary meeting

We listen to the subject of the file, its stage and the time limits. A conflict-of-interest check is carried out. The meeting is held by appointment and on a confidential basis.

02

Document review

Existing documents, service dates and the case file, if any, are examined. We establish which time limits are running and which rights can still be exercised.

03

Roadmap

Options are set out in writing together with their likely outcomes and costs. The engagement and the fee are agreed in a written contract before work begins.

04

Execution and reporting

Information is provided at every stage as the matter proceeds. Hearings, service and time limits are notified in advance; no surprises are left.

Q & A

Criminal Law — frequently asked questions

The first thing to do is to appoint defence counsel before the statement is taken. Once the record of the statement has been signed, it is very difficult to change its content afterwards. Rights of objection concerning the duration and conditions of custody are also subject to limited periods.

As a rule, defence counsel may examine the file. A restriction may be imposed at the request of the public prosecutor and by decision of a judge; however, access by the arrested person or their counsel to the record of the statement and to expert reports is not affected by that restriction.

The duration varies according to factors such as the court's caseload, the state of the evidence, whether an expert examination is required and the number of witnesses. No commitment as to duration can be given in advance for your file; however, the timetable and expectations are shared openly at every stage.

Withdrawal ends the case only for offences prosecuted upon complaint. For aggravated forms of intentional injury or offences concerning public order, withdrawal of the complaint does not bring the proceedings to an end.

Yes. Although based in Ankara, we accept files throughout Türkiye; hearings are attended through the SEGBIS system or in person.

Let us assess your file together.

At the preliminary meeting we discuss the stage of the file, the time limits running and the available options. Meetings are by appointment and confidentiality is essential.
