In immigration law the outcome is usually determined not by the administrative act itself, but by the period within which, and the authority before which, it is challenged. The period for challenging a deportation decision is very short; an objection to an administrative detention decision follows a separate procedure, and delay has consequences that are difficult to remedy.

UTU Hukuk & Danışmanlık handles residence and work permit applications, actions against permit cancellations, acquisition of Turkish citizenship, challenges to deportation and administrative detention decisions, the acquisition of immovable property by foreigners, and the recognition and enforcement of foreign court judgments.

On the corporate side, the employment of foreign personnel, planning work permit applications alongside company obligations, and structuring contracts in line with permit periods form a significant part of the work.

Authorities

Which authorities hear Immigration Law cases?

Depending on their nature, Immigration Law cases are handled before Provincial Directorate of Migration Management, Administrative Court, Criminal Judgeship of Peace, Civil Court of First Instance, Family Court and Regional Administrative Court. The authority before which the matter is heard determines the applicable procedure and time limits from the outset. An application to the wrong authority usually results in lost time.

Process

How do we work?

Every file goes through the same four steps. A stage that is rushed increases the cost of the one that follows.

01

Preliminary meeting

We listen to the subject of the file, its stage and the time limits. A conflict-of-interest check is carried out. The meeting is held by appointment and on a confidential basis.

02

Document review

Existing documents, service dates and the case file, if any, are examined. We establish which time limits are running and which rights can still be exercised.

03

Roadmap

Options are set out in writing together with their likely outcomes and costs. The engagement and the fee are agreed in a written contract before work begins.

04

Execution and reporting

Information is provided at every stage as the matter proceeds. Hearings, service and time limits are notified in advance; no surprises are left.

Q & A

Immigration Law — frequently asked questions

The period is very short and runs from service of the decision. For that reason, consulting a lawyer as soon as the decision is received is decisive in avoiding loss of the case.

An action for annulment may be brought before the administrative court against the refusal. The statement of claim must set out concretely in what respect the grounds for refusal are unlawful.

For applications made from within Türkiye, the employer applies as a rule. Whether the employer meets its employment and wage obligations is decisive for the outcome of the application.

An application may be made where the value and conditions prescribed by legislation are met. The most critical stage is ensuring that the valuation report and transfer records comply with the required procedure.

No. For a foreign court judgment to take effect in Türkiye, an action for recognition or enforcement must be brought.
