Divorce is the termination, by court judgment, of a validly concluded marriage on the grounds and under the conditions laid down by law. The Turkish Civil Code regulates the grounds for divorce in Articles 161-166; divorce may be sought by agreement of the spouses or through contested proceedings based on one of the general or specific grounds listed in the law.

Together with the divorce, the court also rules on maintenance, custody, pecuniary and non-pecuniary damages and, where applicable, wedding jewellery. Custody, maintenance and the matrimonial property regime affect one another; a concession made on one may lead to an unexpected outcome on another. For this reason, UTU Hukuk & Danışmanlık, based in Ankara, structures the divorce cases it handles as a whole from the outset.

Where there is violence or a risk of violence, a request for protective and preventive measures under Law No. 6284 is pursued independently of, and with priority over, the other aspects of the divorce case.

Authorities

Which court hears a divorce case?

Divorce cases are heard by the Family Court; where there is no Family Court, the Civil Court of First Instance (Asliye Hukuk Mahkemesi) decides in that capacity. The court with territorial jurisdiction is that of the place of residence of either spouse or of the place where they lived together for the last six months before the action.

  • Family Court
  • Civil Court of First Instance (acting as Family Court)
  • Land Registry Directorate (family home annotation)
  • Law Enforcement and District Governor (Law No. 6284 measures)

Process

The divorce process step by step

Every divorce case goes through the same four steps. A rushed stage increases the cost of the next one.

01

Preliminary meeting

We listen to the state of the marriage, the children, income and assets, and discuss whether the divorce can proceed as uncontested or contested. A conflict of interest check is carried out. The meeting is held by appointment and on a confidential basis.

02

Document review

Civil registry records, income documents, land registry records, correspondence and any existing case file are reviewed. Since evidence must have been obtained lawfully, each record is also assessed from this perspective.

03

Roadmap

The uncontested divorce protocol or the statement of claim is prepared together with the claims concerning custody, maintenance, compensation and the matrimonial property regime. The terms of representation and the fee are set out in a written agreement before work begins.

04

Execution and reporting

You are kept informed at every stage as the process is conducted. Hearings, the social investigation report, service of documents and deadlines are notified in advance; the appeal and cassation stages are followed in the same manner.

Q & A

Divorce proceedings — frequently asked questions

Uncontested divorce is one of the general grounds for divorce regulated in Article 166/3 of the Turkish Civil Code. Provided that the marriage has lasted at least one year and the parties are in full agreement on the protocol, it may be concluded in a single hearing. Drafting of the reasoned judgment and its becoming final take additional time.

The decisive factor is the best interests of the child. Where custody is disputed, the court orders an assessment by a child development specialist; the report the specialist prepares after interviewing the child and the spouses is called a social investigation report (SİR). The fact that one parent is financially better off is not, on its own, decisive for custody.

Interim maintenance paid during the proceedings, post-divorce maintenance for a spouse in need, which becomes collectable once the divorce becomes final, and child support for a common child may be claimed. The judge cannot award post-divorce maintenance of their own motion; this maintenance may also be claimed within a limitation period of 1 year from the date the divorce judgment becomes final.

If the spouses have not chosen another matrimonial property regime, the regime of participation in acquired property applies, and each spouse is entitled to half of the surplus value belonging to the other spouse. In a divorce, the matrimonial property regime ends with effect from the date the action was filed; liquidation is carried out by agreement or, failing agreement, through a liquidation action brought before the family court.

A person who has suffered violence or is at risk of violence may request protective and preventive measures under Law No. 6284. A protection order may be requested from the most quickly and easily accessible local judge, the district governor or a law enforcement unit; the Law provides that no evidence or documentation that violence has occurred is to be required for protective measures.
