Legal Basis of the Traffic Fine and the Time Limit for Objection

The first issue to consider when objecting to a traffic fine is the time limit. Under Article 27 of the Misdemeanours Law, the person on whom the fine has been imposed may, against the fine imposed, within 15 days has the right to object.

Important · The 15-day time limit

If no objection is lodged within the time limit, the fine becomes final.

How the Fine Is Imposed and When the Time Limit Starts

A traffic fine can be imposed in two ways. The first is where a traffic officer stops the person and issues the fine in their presence; the second is where the fine is issued in the person’s absence against the vehicle’s registration plate.

The manner in which the fine is imposed determines the start date of the time limit for objection:

Fine imposed in person

For a fine imposed on the spot by a traffic officer, the time limit for objection starts on the day it is imposed.

Fine imposed in absentia on the number plate

For a fine imposed in absentia, the time limit for objection starts on the date of service of the relevant traffic fine.

If the traffic fine was issued in the person’s absence, the time limit for objection begins from the date of service of the traffic fine. However, if the traffic fine was issued on the spot by a traffic officer, the time limit for objection begins from the day on which it was issued.

How to Object to a Traffic Fine and Which Documents Are Required

To object to a traffic fine, it must first be borne in mind that the objection must be lodged within the time limit. As mentioned above, the date on which the 15-day period begins must be correctly determined. The objection is made by petition to the criminal judgeship of peace.

The objection process consists of the following stages, in the order described in the article:

  1. Determining the time limitThe date on which the 15-day time limit starts is determined correctly.
  2. Identifying the authorityThe competent authority with jurisdiction to which the petition is to be submitted is correctly identified.
  3. Preparing the petitionThe reasons why the fine should be annulled are set out, based on concrete evidence and precedent decisions.
  4. Assembling the attachmentsA copy of the decision report and photocopies of the vehicle registration, driving licence and identity card are attached to the petition.
  5. Signature and applicationAn application is made to the criminal judgeship of peace with the petition bearing the signature and name details.

Certain documents must be prepared in order to object to a traffic fine. To object to a traffic fine, a petition will first need to be prepared. A copy of the decision report sent to the person fined should be attached to the objection petition. In addition, photocopies of the vehicle registration certificate, driving licence and identity card of the person fined should be added as attachments to the petition.

In brief, the objection petition and its attachments are as follows:

  • Petition of objection
  • A copy of the decision report
  • Photocopy of the vehicle registration
  • Photocopy of the driving licence
  • Photocopy of the identity card

When preparing the objection petition, the court with subject-matter and territorial jurisdiction must be correctly identified. Then the reasons why the fine imposed should be annulled, based on concrete evidence and precedent decisions, should be set out in the petition. The petition should be finalised by adding the signature and name details.
