The support of a traffic accident lawyer in Ankara begins with correctly identifying the losses arising from the accident and directing them at the right person. A traffic accident may give rise to distinct claims, such as repair costs and diminution in value of the vehicle, replacement vehicle cost for the period during which the vehicle could not be used, medical expenses and permanent disability in the event of injury, and compensation for loss of support in the event of death.
Each of these claims is directed against different persons and subject to different limits. While diminution in value may also be claimed from the compulsory traffic insurer of the vehicle at fault, replacement vehicle cost is excluded from cover under the general conditions of compulsory traffic insurance and is therefore, as a rule, directed against the driver, owner or operator of the vehicle at fault. For this reason, UTU Hukuk & Danışmanlık, based in Ankara, structures the traffic accident compensation files it handles as a whole from the outset.
Since Article 97 of the Highway Traffic Law requires a written application to the company before an action or arbitration is pursued against the compulsory traffic insurer, the first step in the file is often to prepare this application in full, together with the accident report, photographs, repair documents and loss adjuster reports.
Scope
UTU Hukuk provides litigation and advisory services in Ankara in traffic accident disputes on the following matters: Vehicle damage and diminution in value, Replacement vehicle cost, Accidents involving injury, Compensation for loss of support, Insurance application and arbitration, Fault ratio and reports and Loss exceeding the limit. A traffic accident file rarely consists of a single claim. The headings below are claims arising from the same accident that need to be assessed together.
Determination and claiming of the economic loss remaining in the vehicle after repair, separately from repair costs, by comparing the vehicle’s pre-accident value with its repaired value.
Where the vehicle is under repair or declared a total loss, the loss-of-use cost calculated on the basis of a reasonable repair period or period for purchasing a new vehicle and the daily rental rate of a comparable vehicle.
Claims for medical expenses and future economic loss due to permanent disability under the health expenses and permanent disability cover of compulsory traffic insurance.
In fatal accidents, claims for loss of support by the deceased’s spouse, children, mother and father and by persons who received regular support from the deceased, as well as non-pecuniary damages.
Preparation of the written application to the compulsory traffic insurer; if the claim is not met, comparison of an application to the Insurance Arbitration Commission with the litigation route.
Assessment of the effect of the fault ratio on compensation; review of the loss adjuster and expert reports on which diminution in value, repair time and the compensation calculation are based.
Directing loss exceeding the cover limit of compulsory traffic insurance against the driver at fault and the operator; where applicable, assessment of voluntary liability insurance within the framework of the policy terms.
Authorities
A written application is first made to the compulsory traffic insurer. If the company does not meet the claim or does not respond in writing within 15 days, an application may be made to the Insurance Arbitration Commission or an action may be brought; the same claim cannot be pursued simultaneously by both routes. In a commercial action against the insurer, mediation is a precondition to litigation; the action is heard by the civil court of first instance or the commercial court of first instance, depending on whether the parties are merchants.
Process
Every traffic accident file goes through the same four steps. Rushing one stage increases the cost of the next.
We listen to how the accident happened, the damage to the vehicle, any injury or death, and the correspondence with the insurance company to date. A conflict of interest check is carried out. Meetings are held by appointment and on a confidential basis.
The accident report, footage, photographs of the damage, service records and information on previous damage are reviewed. Payments made by the insurer and correspondence are assessed separately to determine the remaining claim.
A written application to the compulsory traffic insurer is prepared; if the claim is not met, the Insurance Arbitration Commission and the litigation route are compared. The power of attorney and fees are set out in a written agreement before work begins.
You are kept informed at every stage while the proceedings are conducted. Expert examinations, hearings, service of documents and time limits are notified in advance; objection and legal remedy stages are monitored in the same way.
Q & A
Diminution in value may be claimed from the compulsory traffic insurer of the vehicle at fault; a claim may also be made against the driver at fault and against the operator where the statutory conditions of liability are met. For accidents in 2026, the property damage cover of compulsory traffic insurance is TRY 400,000 per vehicle, and repair costs and diminution in value share this cover. Exhausting the limit does not extinguish the remaining loss; that part may be claimed from the responsible driver and operator.
Since claims for replacement vehicle cost are excluded from cover under the general conditions of compulsory traffic insurance, the traffic insurer is, as a rule, not liable for such a claim; the claim is directed against the driver, owner or operator of the vehicle at fault. Compensation may be claimed by a party who was not 100 per cent at fault in the accident; there is no requirement to submit a document showing that a vehicle was rented.
The claimant does not have to be less at fault than the other party. For example, where the injured driver is found 75 per cent at fault and the other party 25 per cent at fault, the 25 per cent share of the determined diminution in value attributable to the other party may be claimed. However, where one’s own driver is responsible for the entire accident, no payment may be claimed from the other party’s compulsory traffic insurance.
Support is presumed for the deceased’s spouse, children, mother and father; other persons who received regular and actual support from the deceased during their lifetime must prove that support. The claim may be directed against the driver of the vehicle that caused the accident through their fault, the compulsory traffic insurer, the motor own-damage (kasko) insurer if there is a Voluntary Liability clause, the vehicle owner and the operator; non-pecuniary damages may also be claimed.
If the insurance company does not meet the claim in whole or in part, or does not respond in writing within 15 days of the application, an application may be made to the Insurance Arbitration Commission or an action may be brought, subject to the applicable conditions. The same claim cannot be pursued simultaneously before the court and the Insurance Arbitration Commission. For the litigation route, mandatory mediation as a precondition to litigation must be completed; prior mediation is not required for insurance arbitration.
Under Article 109 of the Highway Traffic Law, the limitation period for claims for pecuniary compensation is two years from the date on which the damage and the person liable for compensation became known and, in any event, ten years from the date of the accident. If the claim arises from an act for which criminal law provides a longer limitation period, that longer period applies. It is therefore incorrect to reach a conclusion simply by adding two years to the date of the accident.
