General attachment proceedings
Managing the enforcement request, the payment order and the consequences of an objection to the payment order for monetary receivables not secured by a pledge, whatever their source, such as an invoice or a contract.
Enforcement and Bankruptcy Law · Receivables
Choosing the enforcement route for cheque, promissory note and invoice receivables, the consequences of an objection to the payment order, attachment and precautionary attachment, and lost or bounced cheque procedures; on the creditor’s side.
The first question of a creditor looking for an Ankara debt collection lawyer is which enforcement route is open with the document in hand. Under enforcement and bankruptcy law, proceedings are conducted through different routes depending on the type of receivable and the document held by the creditor; for a monetary receivable not secured by a pledge, general attachment proceedings may be initiated without filing a lawsuit, regardless of whether the receivable is evidenced by a document, and regardless of its source or legal cause.
If the receivable is embodied in a negotiable instrument such as a promissory note, bill of exchange or cheque, the creditor may also use attachment proceedings specific to negotiable instruments. In this route, the debtor’s objection to the signature and to the debt is filed with the enforcement court within five days, and the objection does not automatically stay the proceedings; in general attachment proceedings, by contrast, an objection to the payment order made within seven days stays the proceedings. The difference between the enforcement routes is decisive in terms of objection periods, the effect of an objection and the speed of collection. For this reason, UTU Hukuk & Danışmanlık, based in Ankara, begins the receivable files it handles with a review of documents and time limits.
If a cheque is stolen or lost, the holder may ask the court to prohibit the drawee bank from paying it; if it is known who holds the cheque, proof of entitlement (recovery, istirdat) comes into play, and if not, an action for cancellation of the cheque.
Scope
UTU Hukuk provides litigation and advisory services in Ankara in Ankara Debt Collection Lawyer on the following matters: General attachment proceedings, Cheque, promissory note and bill of exchange proceedings, Removal and annulment of objection, Precautionary attachment, Attachment and asset search, Third-party ownership claims and Lost and bounced cheques. A receivable file is often not limited to a single claim. The topics below arise on the creditor’s side, within the same proceedings or in connection with them.
Managing the enforcement request, the payment order and the consequences of an objection to the payment order for monetary receivables not secured by a pledge, whatever their source, such as an invoice or a contract.
Attachment proceedings specific to negotiable instruments; attaching the original instrument (a photocopy for cheques) to the enforcement request and monitoring the ten-day payment and five-day objection periods.
Continuing proceedings stayed by an objection: removal of objection before the enforcement court with documents under Art. 68 and 68/a of the EBL, or an action for annulment of objection before the general courts, and claims for compensation for wrongful denial of the debt.
Securing a monetary receivable that, as a rule, is not secured by a pledge and remains unpaid despite having fallen due, by provisionally seizing the debtor’s assets under a court order.
Requesting attachment once the proceedings have become final; attachment of movables, immovables and receivables held by third parties through garnishment notices under Art. 89 of the EBL; searching land registry, vehicle registration, bank and SGK (social security) records.
Where, during attachment, it is claimed that the property belongs not to the debtor but to a third party: objecting to the claim and acting as the creditor’s counsel in the third-party ownership action (istihkak) heard by the enforcement court.
Stop-payment orders, recovery and cheque cancellation actions for lost or stolen cheques; for bounced cheques, the proceedings before the enforcement criminal court on the holder’s complaint.
Authorities
Depending on their nature, Ankara Debt Collection Lawyer cases are handled before Enforcement Office (enforcement request and attachment), Enforcement Court (objection, removal of objection, third-party ownership), Enforcement Criminal Court (bounced cheques) and Commercial Court of First Instance (cancellation of cheques). Enforcement without judgment begins with an enforcement request filed with the enforcement office; the enforcement office of general jurisdiction is that of the debtor’s place of residence. In proceedings specific to negotiable instruments, objections are filed with the enforcement court, and third-party ownership actions are also heard by the enforcement court. Cases brought over bounced cheques are heard by the enforcement criminal court, and actions for cancellation of the cheque by the commercial court of first instance.
Process
Every receivable file goes through the same four steps. A rushed stage increases the cost of the next one.
We hear the source, amount and due date of the receivable, your correspondence with the debtor and your expectations, and discuss the options available to you as a creditor. A conflict of interest check is carried out. The meeting is held by appointment and on a confidential basis.
Invoices, contracts, cheques, promissory notes or bills of exchange, formal notices, payment records and any existing enforcement or court file are examined. Whether the document qualifies as a negotiable instrument and whether the debtor acknowledges the signature directly affect the route to be followed.
Which option will be pursued (general attachment, proceedings specific to negotiable instruments, a precautionary attachment request or a lawsuit) is determined together with the running time limits, and the enforcement request, application or petition is prepared accordingly. The terms of representation and the fee are agreed in a written contract before work begins.
You are kept informed at every stage of the process. Attachments, sales, hearings, service of notices and time limits are notified in advance; the appeal and cassation stages are tracked in the same way.
Q & A
UTU Hukuk & Danışmanlık provides litigation and advisory services on the creditor’s side in initiating and conducting enforcement proceedings for cheque, promissory note and invoice receivables, actions for annulment and removal of objection, precautionary attachment requests, attachment and sale procedures, and third-party ownership (istihkak) actions.
A creditor holding a promissory note, bill of exchange or cheque may initiate attachment proceedings specific to negotiable instruments; the original instrument, or in the case of a cheque a photocopy, is attached to the enforcement request. The creditor is not obliged to use this route and may also proceed by general attachment proceedings. In the negotiable-instrument route, the payment order sent to the debtor warns that the debt must be paid within ten days.
In general attachment proceedings, an objection made by the debtor within seven days stays the proceedings. If the creditor holds one of the documents listed in Art. 68 or 68/a of the EBL, it may, within six months of service of the objection on it, request removal of objection from the enforcement court or, within one year, request annulment of objection before the general courts. In proceedings specific to negotiable instruments, however, the objection is filed with the enforcement court within five days and does not stay enforcement steps other than sale.
Final attachment requires the proceedings to have become final and a request from the creditor; it is not necessary to wait for the debtor to make a declaration of assets before attachment. Attachment must be requested within one year of service of the payment order; if it is not requested in time, the file is removed from processing, but the proceedings do not end and the file may be renewed. A precautionary attachment order may also be requested from the court to secure the outcome of the proceedings.
If, during attachment, the debtor indicates that the property belongs to another person, or a third party claims ownership or a right of pledge, the third-party ownership claim (istihkak) is recorded in the report and the creditor and the debtor are given three days to object; a party that remains silent is deemed to have accepted the claim. If the property is in the possession of the third party, the enforcement officer gives the creditor seven days to file a third-party ownership action. The competent court is the enforcement court.
A holder who has been dispossessed of a cheque against their will may ask the court to prohibit the drawee bank from paying it; if it is known who holds the cheque, an action for recovery (replevin) is brought, and if not, an action for cancellation of the cheque. For a bounced cheque, the no-funds endorsement is made at the holder’s request; the offence is prosecuted only upon complaint, the right of complaint belongs to the lawful holder, and the cases are heard by the enforcement criminal court.
