In daily life we enter into many consumer transactions in which we are in the position of consumer. In this article we discuss the scope of the law, the consumer\u2019s elective rights in the face of defective goods or services, and the avenues of recourse in the event of a dispute.<\/p>\n<aside class=\"pm-ozet\" aria-label=\"In brief\">\n<p class=\"pm-etiket\">In brief<\/p>\n<ul>\n<li>Consumer law under Law No. 6502 aims to protect the consumer, as the weaker party to the contract, and to place them at least on an equal footing with the other party.<\/li>\n<li>In the case of defective goods or services, the consumer has the elective rights of withdrawal from the contract, price reduction, repair or replacement with a non-defective equivalent.<\/li>\n<li>In the event of a dispute, the consumer may apply to the Consumer Arbitration Committee or the Consumer Court within the monetary thresholds updated every year.<\/li>\n<\/ul>\n<\/aside>\n<div class=\"pm-not\">\n<p class=\"pm-etiket\">Currency note<\/p>\n<p>This article was prepared on the basis of the legislation and practice in force on the date of its publication. Since the consumer represents the weaker party within the framework of the contract performed, the fundamental aim of consumer protection is the legislator\u2019s intention to protect the consumer and, by granting the consumer certain rights, to place the consumer at least on an equal footing with the other party.<\/p>\n<p>Law No. 6502 essentially regulates matters relating to taking measures that protect the health, safety and economic interests of consumers, compensate their losses, ensure their protection from environmental hazards and inform and raise awareness among consumers, encouraging consumers\u2019 initiatives to protect themselves, and promoting voluntary organisation in the formulation of policies on these matters.<\/p>\n<ul class=\"pm-cipler\" aria-label=\"Kanunun korudu\u011fu alanlar\">\n<li>Health and safety<\/li>\n<li>Economic interests<\/li>\n<li>Compensation for losses<\/li>\n<li>Protection from environmental hazards<\/li>\n<li>Information and awareness-raising<\/li>\n<\/ul>\n<p>No exhaustive list has been laid down for the consumer contracts listed in the Law No. 6502 on Consumer Protection. Indeed, every kind of consumer contract may fall within the scope of the Law. In order to determine the nature of a contract, the purpose for which it was concluded is important.<\/p>\n<\/section>\n<section id=\"ayipli-mal\">\n<h2>The Consumer\u2019s Elective Rights in Respect of Defective Goods and Services<\/h2>\n<p><strong>Consumer law grants the consumer 4 different elective rights where the consumer encounters a defect in the service or goods purchased.<\/strong> First, however, we consider it useful to explain what the concept of \u2018defect\u2019 stated in the law means.<\/p>\n<p class=\"pm-tanim\">Namely, if the goods or services sold do not have the characteristics they should essentially have, for example if they lack one or more of the characteristics stated on the packaging, label, promotional material and user manual, on the internet or in advertisements and announcements, or if they do not incorporate the promised characteristics, the goods or services purchased by the consumer <strong>defective goods<\/strong> olarak kabul edilmektedir.<\/p>\n<p><strong>The 4 different elective rights available to the consumer where the goods or services purchased are defective are listed in the Law as follows:<\/strong><\/p>\n<ul class=\"pm-liste\">\n<li>The right to rescind the contract,<\/li>\n<li>The right to request a reduction in the sale price,<\/li>\n<li>The right to request repair,<\/li>\n<li>The right to request replacement of the goods with defect-free equivalents<\/li>\n<\/ul>\n<p>Upon the consumer\u2019s mere notification, the seller or provider is obliged to fulfil this request.<\/p>\n<\/section>\n<section id=\"basvuru-yollari\">\n<h2>Recourse in a Dispute: Arbitration Committee and Court<\/h2>\n<p>If a dispute arises, the consumer has the right to apply to the Consumer Arbitration Committee or the Consumer Court within the framework of the monetary thresholds updated every year.<\/p>\n<ul class=\"pm-cipler\" aria-label=\"Avenues of recourse\">\n<li>Provincial or District Consumer Arbitration Committee<\/li>\n<li>Consumer Court<\/li>\n<\/ul>\n<p><strong>For 2025,<\/strong> applications may be made to the Provincial or District Consumer Arbitration Committees in consumer disputes with a value of less than TRY 149,000 (one hundred and forty-nine thousand Turkish lira)<em>.<\/em><\/p>\n<p class=\"pm-dipnot\"><strong>Dilara T\u00dcRKER D\u0130ZDAR<\/strong><\/p>\n<\/section>\n<p class=\"pm-dipnot\">Related legislation: <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=6502&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">Law No. 6502 on Consumer Protection<\/a> (mevzuat.gov.tr)<\/p>\n<section id=\"sss\" class=\"pm-sss\">\n<h2>Consumer Law: Frequently Asked Questions<\/h2>\n<details open>\n<summary>Which transactions does consumer law cover?<\/summary>\n<div>\n<p>According to the article, one of the parties to the transaction must be a consumer and the other a seller, provider or a person acting on their behalf.
