In addition, a bill on amending the Code of Civil Procedure and certain other laws was prepared on 20/03/2020 with a view to reviewing the Code in light of the principles governing civil proceedings, enabling proceedings to be conducted more effectively and efficiently, and resolving the procedural problems raised by practitioners and academics.

In brief

The article explains, article by article, the amendments envisaged by the HMK (Code of Civil Procedure) amendment bill dated 20/03/2020, comparing the texts of the provisions before and after the bill.

Under the bill, in an action for an unspecified receivable the judge will grant the claimant a peremptory period of two weeks to specify the claim fully and definitively; the third paragraph of the article will be repealed.

Under the bill, after the exchange of pleadings, claims and defences may not be expanded or amended, subject to amendment of pleadings (ıslah) and the express consent of the opposing party.

Having acted as a mediator or conciliator in the same dispute is added to the grounds for challenging a judge, and the judge is given a duty to inform the parties about settlement and mediation.

The bill envisages an Article 73/A which, subject to certain exceptions, makes applying to a mediator before filing suit a precondition for actions in disputes before consumer courts.

Currency note

This article was prepared on the basis of the legislation and practice in force on its date of publication.
